Scope of Services
FRAG's services include complete mastering and mixing interventions. These services encompass professional sound optimization, stereo enhancement, dynamic range correction, equalization, and preparation of audio files for various distribution platforms. Clients can submit their audio materials via the dedicated online platform, where they will be processed by experienced sound engineers.
Contractual Terms
By using FRAG's services, the client acknowledges and agrees to these general terms and conditions. The contractual relationship is established upon payment confirmation and audio file submission. Each service transaction constitutes a formal agreement between FRAG and the client, governed by French commercial and digital regulations.
Financial Terms
FRAG’s service pricing is transparently displayed on the website and includes all applicable taxes. Payment is made in two installments: 50% of the total project cost is due at the start of the project, with an invoice sent via email and a notification of work commencement. The remaining 50% is due at the end of the project before the final delivery.
The services include three free revisions, except for the 99€ mixing and mastering service, which does not include free revisions. Any additional revisions beyond the initial ones will incur extra charges.
Client Responsibilities
The client guarantees the authenticity and legal ownership of the audio materials submitted for processing. The client must provide high-quality source files compatible with professional audio standards. By submitting audio materials, the client certifies that they hold all necessary rights and authorizations for the content and its subsequent commercial or artistic use.
Confidentiality and Intellectual Property
FRAG commits to maintaining strict confidentiality regarding all submitted audio materials. The client retains full intellectual property rights to their original work. FRAG provides a limited service license for audio processing, without transferring the underlying intellectual property rights. All client files are handled with professional discretion and are deleted after service completion, unless explicitly requested to be retained.
Service Execution and Delivery
The audio processing service will be executed within the timeframe communicated upon order confirmation. Delivery occurs through secure digital download mechanisms. A free revision is included with each service to ensure client satisfaction. Additional modifications beyond the initial revision will incur extra charges.
Guarantee and Professional Responsibility
FRAG guarantees professional-grade audio processing performed by qualified sound engineers. However, the company cannot be held responsible for subjective artistic interpretations or personal aesthetic preferences. The maximum liability is strictly limited to the financial value of the service rendered.
Data Protection
In strict compliance with GDPR and French data protection regulations, FRAG ensures the secure management of all client information. Personal and audio data are treated confidentially, and clients have the right to request the deletion of their data at any time.
Jurisdiction Clause
Any potential dispute will be exclusively governed by French law. The Paris Commercial Court is designated as the competent jurisdiction to resolve any legal conflicts arising from the service provision or the interpretation of these terms.
Modification of Terms
FRAG reserves the unilateral right to modify these general terms and conditions. Changes will be communicated via the website and directly to clients. Continued use of the services after these changes implies tacit acceptance of the updated terms.
